Cynthia O'Neill of LCW's
San Francisco Office was quoted in an article written by
Lawrence Hurley, Daily Journal
Staff Writer,
titled "High Court
Issues Major Race Ruling
New Haven, Conn., Was Wrong to Invalidate Civil Service Test
Because No Blacks Did Well". Here is an excerpt
from the article which was published in the June 30, 2009 issue of
The Los Angeles/San Francisco Daily Journal.
Cynthia O'Neill,
an employment attorney with Liebert Cassidy Whitmore in San
Francisco, said that for local government employers, whom she
represents, the "most disturbing" part of Kennedy's opinion is the
assumption that those who pass tests should always be promoted,
whatever the circumstances.
Promotions are "always a discretionary decision," especially in
times when budgets are tight, she added.
New Haven "made a misstep," O'Neill said, by failing to study the
methodology of the test itself. With more evidence of its adverse
impact on minorities, the city could have won the case, she said.

Mark Meyerhoff of

Daly titled "Supreme Court Sides With AT&T In Maternity Case".
The article ran on Law360 on Monday, May 18, 2009 and includes
commentary from Mark Meyerhoff. His quotes:
Mark H. Meyerhoff, an attorney with
Liebert Cassidy Whitmore, said the case may signal how broadly the
Supreme Court will apply the Lilly Ledbetter Fair Pay Act (LLFPA),
noting that the court had declined to apply the act to the facts
of the case on the grounds that the plaintiffs hadn't been
affected by a discriminatory compensation decision.
In reaching this decision, the high court has carved out an
exception to the LLFPA by precluding claims of discriminatory
compensation where such claims can be tied to the application of a
bona fide seniority system and no intent to discriminate can be
shown, Meyerhoff said.
“It is interesting that the one of the
two dissenters in the Hulteen case is Justice Ginsburg, who
voiced a strong dissent in the Ledbetter case which eventually led
to Congress overturning the decision,” he said. “It remains to be
seen whether Congress will step in to reverse the Supreme Court
yet again.”
