AB 1524 – Requires Drug Testing Devices in Certain Campus Health Centers
Assembly Bill 1524 (AB 1524) requires the California State University and community college districts to stock drug testing devices, accessible and free-of-charge, in the health center located on each campus. AB 1524 defines “drug testing devices” as test strips, stickers, straws, and other devices designed to detect the presence of controlled substances in a drink. The drug testing devices may not be expired. The bill provides that the subject entity shall not bear civil or criminal liability for a defective test or inaccurate test result. Subject entities must post notice of AB 1524’s requirements in a prominent and conspicuous location, such as the campus health center’s website or in new student orientation materials.
AB 1524 encourages the University of California, independent institutions of higher education, and private postsecondary educational institutions to implement these provisions. The bill extends civil or criminal immunity for a defective test or inaccurate test result to such entities if they choose to comply with AB 1524.
