AB 2522 – Amended Compensation Limits for Air District Boar

The Health and Safety Code provides for the creation of various air districts, including but not limited to the South Coast Air Quality Management District, San Diego County Air Pollution Control District, Bay Area Air Quality Management District, Sacramento Metropolitan Air Quality Management District, and Unified Air Pollution Control District. Existing law outlines the structure of each board and the allowable compensation for members of the governing board.

Assembly Bill 2522 (AB 2522) increases the allowable compensation for members of the governing board of the aforementioned Districts. AB 2522 prohibits all of the above-described Air District Boards from providing for automatic future increases in compensation for their members.

South Coast Air Quality Management District

AB 2522 requires that each member of the South Coast Air Quality Management District board receive compensation of $200 for each day, or portion thereof, but not to exceed $2,000 per month, while attending meetings of the board or any board committee or, upon authorization of the board, while on official business of the South Coast Air Quality Management District, and the actual and necessary expenses incurred in performing the member’s official duties.

AB 2522 allows the board to increase the compensation of each member of the board beyond this amount at an open regular meeting.

San Diego County Air Pollution Control District

AB 2522 requires that each member of the San Diego County Air Pollution Control District receive compensation of $200 for each day, or a portion thereof, but not to exceed $2,000 per month, while attending meetings of the board or any board committee or, upon authorization of the board, while on official business of the San Diego County Air Pollution Control District, and the actual and necessary expenses incurred in performing the member’s official duties.

AB 2522 allows the board to increase the compensation of each member of the board beyond this amount at an open regular meeting.

Bay Area Air Quality Management District

AB 2522 provides that each member of the Bay Area Air Quality Management District board is entitled to receive reimbursement for actual and necessary expenses incurred in the performance of board duties.

AB 2522 authorizes Bay Area Air Quality Management District board to provide each member compensation in an amount to not exceed $200 per day, not exceed $2,000 per month, and not exceed $24,000 in any one year for attending a board meeting, or any board committee meeting, or, upon authorization of the board, attending a meeting while on official business of the district.

AB 2522 allows the board to increase the compensation of each member of the board beyond this amount at an open regular meeting.

Sacramento Metropolitan Air Quality Management District

AB 2522 authorizes Sacramento Metropolitan Air Quality Management District board to provide each member compensation in an amount to not exceed $200 per day for attending board and committee meetings, or for conducting official business as authorized by the board. The compensation cannot exceed $12,000 in any one year.

AB 2522 authorize the board, by resolution adopted at an open regular meeting, to increase the amount of compensation provided not more than once every 12 months. An increase must equal the percent change in the California Consumer Price Index for the most recent calendar year, rounded to the nearest one-tenth of one (1) percent, but no more than 10 percent.

Unified Air Pollution Control District

AB 2522 requires each member of the Unified Air Pollution Control District board, upon a resolution adopted at an open regular meeting, to receive the actual and necessary expenses incurred in the performance of their duties, plus a compensation of $200 for each day attending the board meetings or any board committee meetings or, upon authorization by the board, while engaged in official business of the district. The compensation cannot exceed $7,200 in any one year.

AB 2522 allows the board to increase the compensation of each member of the board beyond this amount at an open regular meeting.
