AB 3092 – Updates to In-Custody Death Reports to Attorney General

Under existing law, when a person dies in the custody of a law enforcement agency or correctional facility, the agency must provide the Attorney General with a written report regarding all facts in its possession concerning the death within 10 days.

Assembly Bill 3092 (AB 3092) requires the agency, following this report, to update the Attorney General of new information concerning the in-custody death as it becomes available. If any information that the agency provided changes, or if new information becomes available concerning the death, including, but not limited to, the manner and means of death, the agency must update its written report to the Attorney General within 10 days.
