AB 796 – Athletic Trainer Certification Requirements

Assembly Bill 796 (AB 796) makes it an unfair business practice for a person to hold themselves out as an athletic trainer, or to use specified titles or terms to imply or suggest that the person is an athletic trainer, unless they meet prescribed requirements. Specifically, the person must possess a certification from the Board of Certification for the Athletic Trainer.

AB 796 further provides that a person may not hold themselves out as an athletic trainer if they have been convicted of certain offenses, or if their athletic trainer license or registration from another state is subject to any disciplinary action.

If an employee’s title is changed to comply with these provisions, the bill prohibits a change in employment status as a result of the title change. For employees subject to a collective bargaining agreement, the new law does not take effect until the parties renew the agreement.

(AB 796 adds Article 26, commencing with section 2529.8.1, to the Business and Professions Code.)
